Misdemeanor  vs.  Felony

Misdemeanors are less serious offenses, typically categorized by their maximum jail sentence: 93 days or 1 year. A unique category, "high court misdemeanors," can be punished by up to two years in prison and are handled procedurally like felonies.

Felonies are the most serious crimes, categorized from Class H (least severe) up to Class A (most severe), with potential punishments ranging from several years to life in prison.

The Stakes of an OWI Conviction

An OWI conviction can have a devastating impact on your life. The penalties escalate significantly with each offense:

First-Offense

Up to 93 days in jail, fines up to $500, up to 360 hours of community service, and a 180-day license suspension (30 days hard suspension, 150 days restricted).

First-Offense "Super Drunk" (BAC ≥ 0.17%)

Up to 180 days in jail, fines up to $700, and a one-year license suspension (45 days hard suspension, 320 days restricted with a mandatory ignition interlock device).

​

Second-Offense (within 7 years)

This is a misdemeanor charge, but with much more severe consequences. You could face 5 days to 1 year in jail, fines ranging from $200 to $1,000, 30 to 90 days of community service, and a mandatory driver's license revocation for a minimum of one year. Your vehicle may also be immobilized for 90 to 180 days.

Third-Offense (Felony)

A third OWI in your lifetime is a felony, carrying a mandatory minimum of 30 days in jail (up to 5 years in prison), fines up to $5,000, and a minimum one-year license revocation.
